Enhancing Battery Safety: Proposed New Rule for Warning Labels and Packaging

The Consumer Product Safety Commission has proposed a new rule that would require companies manufacturing, importing, or distributing button cell or coin batteries, as well as consumer products containing these batteries, to comply with warning label requirements and packaging standards. This rule is a result of Reese's Law being enacted and aims to improve battery safety. Additionally, companies would need to provide technical and performance data concerning the safety of these batteries at the point of sale, both online and in stores.

To adhere to the rule, companies must ensure that their packaging includes a warning label clearly stating the hazards of ingesting the batteries and advising consumers to seek immediate medical attention if ingestion occurs. The packaging must also indicate that the batteries should be kept away from young children. The comment period for this proposed rule closed on March 13, 2023.
