Draft Proposal to Modernise TSCA Raises Concerns

On 22 January 2026, the House Energy and Commerce Subcommittee considered a Discussion Draft proposing wide-ranging amendments to the Toxic Substances Control Act. The draft would narrow the definition of “conditions of use,” limit new chemical reviews to scenarios identified by submitters, and place greater emphasis on existing chemical data over modelled data in risk evaluations. Democratic lawmakers criticised the proposal as weakening EPA’s ability to protect public health, and bipartisan support is not currently anticipated.
