Minnesota PFAS Reporting: Older Products Now Excluded from Scope

On 28 May 2026, Minnesota passed a legislative amendment modifying the state's PFAS-in-products reporting requirements under Amara's Law. The change is effective immediately and applies to initial reports due on 15 September 2026.

Previously, manufacturers were required to report all products containing intentionally added PFAS sold, offered for sale, or distributed in Minnesota, regardless of when they were manufactured. The amendment now limits that obligation to products manufactured after 1 July 2023. Products made before that date are excluded from the reporting requirement.

The change reflects practical feedback from manufacturers, particularly those responsible for replacement parts produced before Amara's Law was enacted, for whom sourcing PFAS composition data on older products was difficult or in many cases impossible.

The amendment is narrow in scope. The core framework of Amara's Law is unchanged: the goal of phasing out all nonessential PFAS uses in Minnesota by 2032 remains in place. The reporting obligation continues to apply to any product that meets all three conditions: manufactured after 1 July 2023, sold or distributed in Minnesota, and containing intentionally added PFAS.

Initial reports are due on 15 September 2026. Manufacturers who have requested and received a 90-day extension have until 14 December 2026. The full text of the amendment is available in 2026 Minn. Laws, ch. 127, art. 14, §4.
