PFAS: New Mexico Becomes Third State to Ban Intentionally Added PFAS in Products

New Mexico legislators have approved legislation banning certain PFAS in consumer products. The Bill has been signed by the Governor on April 8, 2025. The restrictions will apply gradually from January 1, 2027, when the first product-groups will be affected, e.g. firefighting foam. Reporting requirements will apply to manufacturers who must then report PFAS-containing products to the state. Information that must be reported includes:

  • A brief description of the product;
  • The purpose of the PFAS in the product;
  • The amount of each PFAS in the product;
  • Manufacturer contact information; and
  • Any additional information requested by NMED as necessary.

From January 1, 2032 a general ban on PFAS in all products will apply, unless an exemption can be claimed (Link).
