2024-10-14 - Updates to EU POPs Regulation: New Rules for HBCDD and Methoxychlor

As of 14th of October the Compliance Data Exchange (CDX) has been updated to reflect the latest changes to the EU Persistent Organic Pollutants (POPs) Regulation. On September 27, 2024, the European Commission announced two important amendments that introduce new restrictions and adjust existing thresholds for specific substances.

The first amendment, (EU) 2024/2555, focuses on hexabromocyclododecane (HBCDD), a flame retardant commonly found in electronics like televisions and computer monitors. The allowed concentration threshold for HBCDD as an unintentional trace contaminant (UTC) has been lowered from 100 mg/kg to 75 mg/kg in substances, mixtures, or flame-resistant products. However, there’s still a higher limit of 100 mg/kg for recycled polystyrene used in the production of expanded polystyrene (EPS) and extruded polystyrene (XPS) insulation materials in construction.

The second amendment, (EU) 2024/2570, adds methoxychlor to Part A of Annex I of the POPs Regulation. This substance includes any possible isomer of dimethoxydiphenyltrichloroethane and is often used as an insecticide for agricultural crops, livestock, and home gardens. The new regulation sets a strict concentration limit of 0.01 mg/kg (0.000001% by weight) for methoxychlor in various products.

These amendments highlight the EU's commitment to reducing the environmental and health impacts associated with persistent organic pollutants. Both changes will take effect on October 17, 2024 - twenty days after their publication - so businesses will need to adapt their processes accordingly.
